General Conditions of club YO
The YO de iryo loyalty programme aims to reward the loyalty of customers of the company INTERMODALIDAD DE LEVANTE, S.A., with registered office at Avenida Comarcas del País Valenciano, 2, 46930 Quart de Poblet (Valencia) y N.I.F. A-98728611 (hereinafter, ILSA).
Membership of the Yo de iryo programme is personal and non-transferrable. Travel agencies, wholesalers, and intermediaries cannot hold a Yo de iryo account as this is aimed at the end customer and is only available to natural persons.
ILSA reserves the right to modify these conditions at any time. In the event of this, ILSA will inform members of the programme of the changes at least one month before via email and on their WEBSITE, indicating the date from which the changes will come into effect.
In the event of this, any customer who wishes to unsubscribe from the programme, must notify ILSA by email at the address provided below, within one month of the date of the notification of the change in conditions, and are able to use all their accumulated iryo point in this period, without being able to claim any compensation from ILSA for this reason.
If at any time circumstances of force majeure or legal impositions occur that prevent its continuation, the Yo de iryo programme will be cancelled without notice or liability and the above provisions will not apply.
These terms and conditions shall apply from the 25 September 2022.

AIM OF THE YO DE IRYO PROGRAMME
The Yo de iryo programme grants advantages and iryo points to the account holder for buying ILSA tickets, products and services. These points can be used for subsequent purchases on digital channels to obtain discounts in line with the rules specified on the iryo.eu WEBSITE.
The account holder must consult the applicable conditions for each product and discount offered related to the collection of iryo points, published on the iryo.eu WEBSITE.
Being a Yo de iryo customer implies receiving, through any means, including email, text, push notification, web notification or telephone, information on Yo de iryo, news, services and/or ILSA promotions. If the customer does not wish to receive commercial notifications, they may unsubscribe at any time for free, by modifying their personal Yo de iryo profile, accessible on the WEBSITE iryo.eu or by sending an email to [email protected].
The programme offers different levels of benefits depending on the amount accumulated by the customer, who can move from one level to another according to the rules specified on the iryo.eu WEBSITE.

CONDITIONS OF THE YO DE IRYO PROGRAMME
Any natural person over the age of 18 (hereinafter “programme member” or “programme members”) may participate in the Yo de iryo programme. Minors cannot join the programme.
Joining the Yo de iryo programme is completely free and implies knowledge and acceptation of these terms and conditions.
To become a member of the Yo de iryo programme, customers need to fill in the WEB form, allowing them to access a personalised client area, from where, after making a purchase, the programme member can collect their iryo points.
To identify themselves as a member of the Yo de iryo programme, the customer will have a membership number displayed on their profile. This number is personal and untransferable and its use by another natural person other than the account holder will be considered fraudulent use.
Cancellation of the subscription may be requested by the account holder at any time via the established channels. Yo de iryo customers who have not had any activity on their account in 24 months will be considered inactive.
ILSA reserves the right to cancel the account of iryo points and the balance and cancel the status as a Yo de iryo customer for any member who does not comply with the rules presented in these conditions or who makes fraudulent use of the tickets or sales of services through any of ILSA sales channels.
ILSA reserves the right to cancel the Yo de iryo loyalty programme at any time, notifying the customers a month beforehand without any liability for damages that the cancellation may cause to them. If the Yo de iryo customer has enough points to exchange them for tickets, they may do so within the month. After the month has passes, the points balance can no longer be claimed and will automatically expire.

ADHESION
To become a member of the Yo de iryo programme, fill in the corresponding application form on the iryo.eu WEBSITE. By joining Yo de iryo, the programme member is responsible for providing correct, precise up to date and complete information on the registration form. If it is not, ILSA can, immediately, suspend or cancel their iryo points account and refuse access to the programme, both now and in the future due to the cancellation of their membership. The Yo de iryo member may request to leave the programme at any time, by sending an email to [email protected], indicating their wish to cancel their membership.
The Yo de iryo customer declares that all the data reflected in the membership form are true, that he/she knows and accepts the conditions of this loyalty programme and that, by his/her consent, he/she voluntarily adheres to them, the first purchase of an ILSA ticket constituting an express declaration of full knowledge and acceptance of these conditions.

ADDITIONAL BENEFITS
Members of the Yo de iryo programme can benefit from exclusive promotions which will be valid for some or all members. These promotions may be temporary or sustained over time. In both cases, the terms of these promotions will be available on the WEBSITE iryo.eu for the length of the promotion and it will be specified in them if the benefits of the promotion are accumulable or not to the benefits already obtained by programme members.

COLLECTING POINTS
The Yo de iryo customer who purchases ILSA tickets or other ILSA products and services which generate iryo points, as detailed on the iryo.eu WEBSITE, will collect iryo points. Which products generate points and how many points are generated for each purchase, depending on the value bracket in which the programme member is located, is clearly specified on the iryo.eu WEBSITE.
If the purchases have been made outside the logged-in environment (personal profile of the programme member) and if the product is one of those that generate iryo points, the programme member can claim the iryo points in his/her private profile on the iryo.eu website using the ticket reference number as the identification field. Only purchases in which the traveller and the Yo de iryo account holder are the same person can be claimed, and only if the ticket has not generated points which have been assigned before to this or another account.
ILSA reserves the right to modify the number of iryo points collected at each time for the purchase of tickets or other products which generate iryo points, as specified on the iryo.eu website.
Collecting iryo points is personal as the customer must identify themselves when purchasing as a member of the Yo de iryo programme, in order to collect the iryo points corresponding to the ILSA products which generate points with their purchase.
Points will be added in the 48 hours after the date of travel indicated on the ticket. ILSA is not responsible for any delay that may occur in the recording of transactions when causes beyond ILSA's control make the automatic capture of transactions impossible. ILSA reserves the right to cancel iryo points that have been added in error to customers’ accounts. The automatic recording of iryo points will only be guaranteed if the status of the account holder and traveller have been duly accredited and registered when the ticket was purchased.
The right to request the crediting of iryo points that have not been recorded in the customer's account must be exercised within one month of the day after the trip and in accordance with the provisions of the corresponding section on iryo.eu.
Yo de iryo points will expire 12 months after collection. Once this period of time has passed, they will be discounted from the customer account without the possibility of being reassigned or redeemed.
In the event of cancellation of tickets and/or contracted products and services that generate iryo points, the right to obtain any iryo points for the cancellation will be lost.

The Yo de iryo customer may check the balance and transactions of their points account on the iryo.eu WEBSITE by accessing their personal area.

REDEEMING POINTS
The redemption of points can only take place within the Yo de iryo programme, in exchange for ILSA tickets, products or services available for this purpose and specified on the relevant iryo.eu WEBSITE.
Under no circumstances may iryo points be exchanged for money.
The customer may use the points exclusively as a form of payment of the ILSA ticket price and, if applicable, for additional services that ILSA considers relevant and that are defined on iryo.eu, exchanging the available iryo points for their equivalent in euros, in accordance with the exchange equivalence in force at any given time.
The customer may also redeem accumulated iryo points for discounts on the amount of ILSA tickets or products purchased; the number of iryo points required to obtain the aforementioned discount will be determined, in each case, according to the itinerary, the customer's level of value and the type of service in question. The discount available will be indicated during the process to purchase the ticket, and specified on iryo.eu.
Iryo points can only be redeemed via the digital channels in operation at the time (iryo.eu WEBSITE and iryo app)

DATA PROTECTION
- 8.1 Who is the Data Controller for the data provided to Yo de iryo?
ILSA is the Data Controller for the personal data provided for subscription to the Yo de iryo loyalty programme. The data marked with an asterisk must be filled in, and failure to do so will make it impossible to register with Yo de iryo. We understand that the information provided by the applicant is true, in which case ILSA reserves the right to exclude from the programme those clients who have provided false or inaccurate information.

The processing of your data for advertising purposes by ILSA includes the sending of commercial communications, by any means, including e-mail, text, push notification, WEB notifications or other equivalent electronic means of communication or telephone contact, of any information on services, news and/or promotions of both ILSA and the establishments associated with Yo de iryo related to the leisure, transport, hospitality, training, telecommunications, fashion, retail trade and insurance as applicable. You can consult the establishments associated with Yo de iryo via the iryo.eu WEBSITE. Consent is given by ticking the box provided for this purpose.ILSA has carried out a weighing of interests, concluding that the company has a legitimate interest in adapting ILSA's strategy and commercial offer based on the information obtained from the transactions carried out in the different sales channels, as well as in obtaining information that allows us to know the market in which ILSA operates and its evolution, all with the aim of organising resources in the most efficient way possible in the process of selling our services.
- 8.3 Will my data be shared?
The purchase data will be transferred to the platform in charge of calculating the balances and points of the loyalty programme. Cases, such as the calculation of points, in which ILSA commissions a third party to process your personal data in the context of a service provision between ILSA and that third party, shall not be considered as a transfer of personal data.
The platform that calculates the points balances is managed by INLOYALTY BY TRAVEL CLUB, S.L.U., with registered office at Avenida de Bruselas 20, 28108 Alcobendas - Madrid, holder of Tax Identification Number B-86794419, to which ILSA will provide the data of the members of the programme that are necessary to enable the management of the iryo points, both in their obtaining, redemption and validity, the calculation of the value brackets and the management of communications related to the information of the loyalty programme for the members of the programme.
Please also note that a law may require ILSA to disclose your personal data to a judicial or administrative authority or for any other legally established reason.
No international transfers will be made to third countries outside the European Union.
- 8.4 For how long will data be kept?
ILSA will keep the data provided for the time necessary to fulfil the contractual relationship, for the correct calculation and functioning of the services offered by the Yo de iryo loyalty programme. The data will subsequently be blocked in general, except during the periods of limitation of responsibilities required by the legislation in force or by administrative and/or judicial injunction. Likewise, where the legal basis is consent, ILSA will retain the data until the data subject withdraws it.

APPLICABLE LAW AND JURISDICTION
These terms and conditions shall be applied and interpreted in line with Spanish legislation. For any disputes that may arise from the interpretation or application of the same, the parties, expressly waiving any other jurisdiction that may correspond to them, agree to submit to the Courts and Tribunals of the city of Madrid.
